What is a Public Defender?

Many movies depict public defenders as unintelligent, overwhelmed, and incompetent lawyers. This is really not the case. There are many different types of lawyers. For example, a bankruptcy attorney is not the same as someone who would help with foreclosure issues. In this city, these defenders are overworked, but they are more than competent people. They are overworked because they have a limited staff and there is a lot of work to be done everyday. By definition a public defender is a lawyer who is appointed to those who cannot afford to pay for a private lawyer. Below is a list of duties that are accomplished each week by public defenders:

Alternatives To Bankruptcy, Chapter 13 Bankruptcy, Humble Bankruptcy Lawyer,

1. Each week, usually just one day, public defenders go to a specific area to meet with new clients that they are assigned. Sometimes, these lawyers have to go to jail in order to meet the clients. At this meeting, the lawyer tries to get an understanding for why the individual was accused of the crime they are in jail for. It can be hard to get information from the client because a lot of times clients do not want to trust a lawyer that is appointed to them.

2. Many times, the families of the clients call the public defender in an attempt to find out when their loved one will appear in court. This is because if their family member is in jail, it can be difficult to get information, since the client usually has a limited number of phone calls he/she can make from jail.

3. If the client is out of jail, it is normally the job of the defender to make sure the individual knows when they need to appear in court. Sometimes this can be challenging because the clients usually change phone numbers and addresses pretty frequently.

4. Obviously, the lawyers need to be in court to defend their client's interests if they go to trial or if they need to make a deal. The job of a defender is the same as any other lawyer because they need to do their best for their clients for every case. They are responsible for conducting the trial if it comes to that and they make plea deals for their clients as well.

5. Finally, most defenders sit in on other cases that are being tried. This is in order to learn new things and hear different ways to argue a case. Also, lawyers may appear at other cases because their client may be involved in some way with the person who is on trial or appearing in court.

Many times, defenders do this job for lower pay and a lot more work because they believe that everyone has the right to have a good lawyer and have their rights defended. This job can also be a great learning experience for young people before they move on to a big law firm or before they start their own practice. So, unlike what you may see in movies, public defenders are hard-working and usually they are very intelligent.
